Primavera, Boyd March 1 -- House Judiciary Fact Sheet: HB 1248  
HB 1248 creates the "Colorado Safe Personal Care Products Act," which prohibits a manufacturer from knowingly selling, offering for sale, or distributing for sale or use in Colorado any personal care product that contains a chemical identified as causing cancer or reproductive toxicity.  HB 1248 also permits private citizens to file suit to enforce the act against manufacturers who are not in compliance with the bill.  If a manufacturer violates the act, the bill authorizes the imposition of a civil penalty of up to $5,000 per violation per product for the first offence and up to $10,000 per violation per product for a second or subsequent offence.
 
Many products sold in the US contain toxic ingredients such as formaldehyde, phthalates, Bisphenol A, polybrominated diphenyl ethers, and coal tar. These ingredients are linked to cancer, birth defects, and adverse reproductive health outcomes including miscarriages, endometriosis, male genital defects, low sperm count, and more.
 
The leading cause of female infertility is endometriosis, which has been linked to chemical exposure.

Fact Sheet: Yes on HB 1021  
Currently, Colorado has a maternity coverage gap when it comes to insurance coverage for pregnancy. Families who purchase health insurance through the individual market -- where more than 130,000 women aged 19-64 got their health insurance in 2008 -- currently don't get pregnancy coverage as a core benefit. However, pregnancy coverage is a core benefit for all other insurance options. It's time to close that gap!
 
(Note: This summary applies to the bill as introduced. Amendments may change the accuracy of this summary.) HB10-1021 closes the maternity coverage gap by adding individual sickness and accident insurance policies to the list of those required by statute to (a) provide maternity coverage and (b) ensure policies do not exclude pregnancy coverage on the grounds that pregnancy is a pre-existing condition. The bill also requires all individual and small group sickness and accident insurance policies to cover contraceptive counseling, drugs, and devices in the same manner as any other sickness, injury, disease, or condition that is otherwise covered under the policy.
 
The bill does not require coverage for abortion.
